How to report copyright concerns, submit DMCA notices, and send counter notices for content on ColabaseAI

1. Purpose

ColabaseAI respects intellectual property rights and expects users to do the same. This policy explains how copyright owners, authorized agents, and affected users can submit copyright complaints, including notices intended to comply with the U.S. Digital Millennium Copyright Act ("DMCA") where applicable.

This policy is for copyright concerns. Trademark, brand impersonation, right-of-publicity, privacy, and safety reports may involve different legal or policy issues. You may send those reports to legal@colabase.ai, or to abuse@colabase.ai for safety and prohibited-content issues.

If ColabaseAI confirms and publishes a U.S. Copyright Office designated-agent registration, we will update this page with the legally required agent information, including the agent name, physical address, telephone number, and email address.

3. Fast Removal Requests

If your work appears in a public part of ColabaseAI, such as the Gallery, a prompt page, a blog post, marketing material, or another public page, you can ask us to review it quickly by emailing legal@colabase.ai.

Please include the public URL, a short explanation of your concern, and enough information for us to identify the material. Where appropriate, we may remove or disable access to the material without requiring a full formal notice.

Fast removal requests are informal review requests. They may help us locate and review public material quickly, but they may not include all information required for a formal DMCA notice and may not trigger the statutory counter-notice process unless we treat the request as a formal copyright notice.

To submit a formal copyright or DMCA notice, email legal@colabase.ai with the subject line Copyright / DMCA notice.

Your notice should include:

  1. Your physical or electronic signature, or the signature of the person authorized to act for the copyright owner.
  2. Identification of the copyrighted work you claim has been infringed. If the notice covers multiple works, you may provide a representative list.
  3. Identification of the material you believe is infringing, including the exact ColabaseAI URL or other information that lets us locate it.
  4. Your contact information, including your legal name, mailing address, telephone number, and email address. If you are submitting the notice on behalf of an organization, please identify the organization and your relationship to it.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the owner's agent, or the law.
  6. A statement that the information in the notice is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on the owner's behalf.
  7. The action you request, such as removal, disabling public access, or another specific measure.

Incomplete notices may delay our review. We may ask for more information if we cannot identify the work, the reported material, or your authority to act.

5. How We Handle Notices

After receiving a copyright notice, we may:

  • acknowledge receipt and ask for missing information;
  • review the reported material and related account activity;
  • remove the material, disable public access, restrict sharing, or take another proportionate action;
  • preserve records needed for legal compliance, abuse prevention, dispute handling, or repeat-infringer enforcement.

If we remove or disable access to material associated with a user account based on a formal copyright notice, we will take reasonable steps to notify the affected user, unless we are legally restricted from doing so or there is a safety, abuse, or security reason not to.

We may share the contents of a copyright notice, including the complainant's contact information, with the affected user, our service providers, legal advisors, or other parties as needed to process the notice, handle disputes, prevent abuse, or comply with law.

We do not adjudicate ownership disputes between private parties. Our response to a notice does not mean that we have made a final legal determination about copyright ownership, infringement, fair use, licensing, or the copyrightability of any AI-generated output. If a dispute cannot be resolved through the notice process, the parties may need to resolve it directly or through the appropriate legal forum.

6. Counter Notices

If material associated with your account was removed or disabled because of a copyright notice and you believe the action was taken by mistake or misidentification, you may email legal@colabase.ai with the subject line Copyright counter notice.

Your counter notice should include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal or disabling.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which ColabaseAI may be found.
  6. A statement that you will accept service of process from the person who submitted the original copyright notice or an agent of that person.

Where appropriate, we may forward a valid counter notice to the original complainant. If the U.S. DMCA applies, we may restore the material not less than 10 and not more than 14 business days after receiving a valid counter notice, unless the original complainant notifies us that they have filed an action seeking a court order to restrain the disputed activity.

7. Repeat Infringement and Misuse

We maintain a repeat infringer policy. In appropriate circumstances, we may suspend or terminate accounts of users who repeatedly infringe copyrights or repeatedly submit material that creates copyright risk for the Service.

We may consider factors such as the number of valid copyright notices, the seriousness of the reported conduct, counter notices, repeat uploads of the same or similar material, and attempts to evade enforcement.

We intend to comply with applicable requirements regarding standard technical measures and will not knowingly interfere with lawful, industry-standard measures that apply to the Service.

Please do not submit false, misleading, or abusive notices. Copyright notice systems affect other users' access to content. Misuse may result in account restrictions and may create legal liability.

8. AI-Generated Content

ColabaseAI is an AI image creation platform. Copyright concerns may involve generated images, uploaded reference images, prompts, public Gallery entries, or other outputs.

This notice process is intended for specific material available on or through ColabaseAI. If your concern relates to a generated output, uploaded reference image, public prompt, Gallery entry, or other identifiable material, please provide the relevant ColabaseAI URL or enough information for us to locate it.

If your concern relates to a third-party model, training data, or material not hosted by ColabaseAI, we may ask you to identify the specific ColabaseAI material at issue or direct you to the relevant third-party provider.

When reporting AI-related material, please explain which protected work you believe is being copied or misused, how the ColabaseAI material relates to it, and where the material appears on the Service. If the report concerns content you generated through ColabaseAI and you want it removed from a public feature, please identify the relevant output and the public URL.

This policy does not determine whether any AI-generated output is copyrightable in a particular jurisdiction.
