1. About These Terms
These Terms of Service ("Terms") govern your access to and use of ColabaseAI (the "Service"). By creating an account, signing in, or using the Service in any other way, you agree to be bound by these Terms.
If you do not agree, please do not use the Service.
We may update these Terms from time to time. Material changes (changes that meaningfully affect your rights, our obligations, the scope of data we collect or use, our license to Your Content, our training policy, account deletion or retention rules, payment or refund rules, dispute resolution, or governing law) will be reflected by an updated Effective date at the top of this page and a corresponding entry in our Changelog. We may also notify you of material changes by email, in-product notice, or other reasonable means. Continued use of the Service after the Effective date of an updated version constitutes your acceptance of the updated Terms. Non-material changes (clarifications, formatting, typo fixes) will be reflected only by an updated Last updated date.
2. About ColabaseAI
The Service is operated by Shanghai Fortune Singularity Tech Co., Ltd. ("ColabaseAI", "we", "us", or "our"), a company registered in Shanghai, China.

3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 and that you have the legal capacity to enter into these Terms in your jurisdiction.
4. Your Account
When you create an account, you agree to provide accurate and current information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You may sign in using third-party authentication providers (such as Google). Their terms and privacy policies will additionally apply to your use of those services.
5. The Service
ColabaseAI is an AI image creation platform. The Service includes, among other things:
- A curated Gallery of AI-generated images organized by intended use case.
- AI image generation and editing through a controlled web interface.
- Curated model options and prompt workflows designed for product, marketing, and creative image use cases.
The features available to you depend on your account type, subscription, and configuration. We may add, change, or remove features at any time.
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or able to produce any specific result.
6. Your Content and Intellectual Property
This section is the heart of these Terms. Please read it carefully.
6.1 Rights You Retain
You retain any rights you may have in the images, prompts, reference images, and other content you create or upload through the Service ("Your Content").
The legal protection available for purely AI-generated images varies across jurisdictions, and we make no representation that any specific image will qualify for copyright or other intellectual property protection. We do not claim ownership of Your Content.
6.2 License You Grant to ColabaseAI
By using the Service, you grant ColabaseAI a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display Your Content solely as necessary to:
- provide, maintain, secure, support, and improve the Service;
- perform technical processing, backups, abuse prevention, fraud detection, customer support, billing, and dispute resolution;
- perform internal quality review, model routing, performance analysis, and cost analysis;
- perform internal review of generations that may be suitable for future Gallery features or promotional use.
This license is limited to the purposes above. It does not authorize public use, marketing use, transfer of rights to third parties, or training of AI models.
6.3 Public Use Requires Your Separate Consent
We will not publicly display Your Content in our Gallery, marketing materials, blog posts, social media, or other public communications unless you give us separate, explicit consent for that specific image.
Where we wish to feature a specific generation publicly, we will contact you by email and request your consent. The email will specify the image, the intended use, the duration, and how you can withdraw your consent. Your reply with a clear affirmative phrase (such as "I consent" or "我同意") is required for us to proceed.
Consent is per image. Granting consent for one image does not authorize use of any other image, and does not authorize use beyond the specific purposes set out in the consent request.
We may, subject to your consent, use the granted image in reasonable derivative formats required for the intended use (such as cropping, resizing, compression, watermarking, and platform-size adaptation). Consent does not include substantive content modification, secondary generation derived from the image, use to train AI models, or sublicensing to third parties for their independent commercial use.
6.4 Withdrawing Your Consent
You may withdraw any consent you have previously given by sending an email to support@colabase.ai identifying the image(s) you wish to remove.
Once we receive your withdrawal request, we will remove the image from our Gallery within 7 days. Materials already published in fixed form (for example, blog posts already published on our site, social media posts already posted, newsletters already sent, printed materials already produced) will not be retroactively edited or deleted, but we will not use the image in any new materials after the withdrawal.
We retain consent records (including a snapshot of your email and display name at the time of consent) as a legitimate exception to deletion for the purpose of defending against future legal claims relating to public use of the image. These records are retained for at least five (5) years, or longer if the image remains in active public display or if there is a pending dispute, complaint, or legal request relating to it, after which they are deleted under our retention policy.
6.5 Reference Images
Reference images you upload as inputs to a generation task are stored in our private internal storage. They are used only to perform the generation task you initiated. They are not displayed publicly and are not used for any other purpose unless you separately authorize it.
You represent and warrant that you have all rights necessary to upload, use, and have ColabaseAI process each reference image.
6.6 Training of AI Models
We do not currently use your generated images, reference images, or prompts to train AI models. If we ever introduce such use, we will obtain your separate, explicit consent first.
6.7 Effect of Account Deletion
If you delete your account, the license described in Section 6.2 terminates for content that is no longer needed to provide the Service, comply with applicable law, resolve disputes, prevent abuse, maintain security, or preserve de-identified analytics.
Content for which you previously gave consent under Section 6.3 may continue to appear in the materials covered by that consent, subject to your withdrawal rights in Section 6.4.
7. Acceptable Use
You agree not to use the Service, including the generation, upload, edit, or distribution of any content through the Service, in connection with any of the following. This section is supplemented by our Acceptable Use Policy.
- Child sexual abuse material (CSAM) or any sexualized depiction of minors.
- Sexualization of minors in any context, including suggestive, suggestively stylized, or implied minor sexualization.
- Adult, sexually explicit, pornographic, erotic, fetish, nude, or otherwise NSFW content of any kind, including fictional, anime, stylized, or consenting-adult depictions.
- Non-consensual sexual content, including sexual depictions of identifiable real persons without their explicit consent.
- Targeted deepfake harassment, including sexualized or otherwise harmful depictions of real individuals intended to harass, defame, intimidate, or impersonate them.
- Terrorism and violent extremism, including content that promotes, glorifies, or facilitates terrorist activity or violent extremist organizations.
- Extreme violence and gore intended to shock or terrorize, or to incite violence against any person or group.
- Self-harm and suicide encouragement, including content that promotes, glorifies, or provides instructions for self-harm or suicide.
- Hate speech and discrimination targeting individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics.
- Illegal activities, including unlawful weapons, controlled substances, human trafficking, and any activity that violates applicable laws in your jurisdiction or in the jurisdiction where the Service operates.
- Privacy violations, including the unauthorized depiction of identifiable individuals, exposure of private personal information, or harassment.
- Impersonation and fraud, including content intended to impersonate real persons or organizations, or to commit fraud.
- Intellectual property infringement, including unauthorized reproduction of copyrighted works, trademarks, or other protected materials.
- Misleading information in matters of public significance, including misleading medical, legal, financial, or electoral content presented as factual.
- Platform abuse, including automated scraping, circumvention of rate limits, exploitation of security vulnerabilities, or interference with the operation of the Service or other users.
This list reflects categories that are commonly recognized as harmful and that violate applicable laws including, without limitation, China's Interim Measures for the Administration of Generative Artificial Intelligence Services and Provisions on the Administration of Deep Synthesis of Internet Information Services, as well as comparable rules in other jurisdictions where the Service is available.
8. Content Safety and Reporting
We take a reasonable and proportionate approach to content safety. We use technical and operational measures designed to detect and block clearly prohibited content, including prompt checks, reference-image checks, generated-output checks where available, manual review, account restrictions, and abuse reporting workflows. Upon actual knowledge of CSAM, we report to the National Center for Missing & Exploited Children (NCMEC) and to other competent authorities as required by applicable law.
We do not guarantee that all violating content will be detected and prevented. The presence of detection systems does not relieve you of your obligations under Section 7.
Reporting violations. If you believe content on the Service violates Section 7, please email us at abuse@colabase.ai with the details. We aim to review reports within 24 to 72 hours, though response times may vary depending on volume and complexity.
Enforcement. Where we determine, in our reasonable judgment, that content or use of the Service violates these Terms, we may take one or more of the following actions: refuse to generate the requested content, remove the content, restrict feature access, suspend the account, terminate the account, and, where required by applicable law, report the matter to competent authorities. We aim to apply enforcement proportionate to the severity of the violation.
9. Payment and Subscriptions
Where you purchase a subscription, credits, or other paid feature:
- Pricing is shown at the point of purchase and may change over time. Changes do not apply retroactively to prior purchases.
- Payments are processed by a third-party payment provider (Stripe or Creem, depending on your account configuration). Their terms and privacy policies additionally apply to your payment.
- Subscriptions auto-renew unless cancelled before the end of the current billing period. You can cancel your subscription at any time through your account settings.
- Refunds are at our reasonable discretion. We will follow applicable mandatory consumer protection rules in your jurisdiction.
10. Suspension and Termination
We may suspend or terminate your access to the Service if you violate these Terms, if we are required to do so by applicable law, or if your continued use creates material risk to the Service, other users, or third parties. Where reasonable, we will give you notice and an opportunity to address the issue before termination.
You may terminate your account at any time. Please see Section 11 for what happens to your data on account deletion.
11. Account Deletion and Data Retention
When you submit a request to delete your account, your data is processed in three phases:
- Day 0 (request received). Your account enters a recovery state. You can cancel the deletion request within the recovery period.
- Day 30 (end of recovery period). Your generated images are taken offline from the public CDN and your account is marked for final cleanup.
- Day 60 (final cleanup). Identifiable personal information (including the link between your user_id and your email, display name, and OAuth identifiers) is deleted; raw prompts and reference images are deleted; certain row-level metadata is retained in a de-identified form for up to 24 months for cost accounting and product analysis; aggregated, anonymous statistics are retained indefinitely.
Some data is retained for longer where required by law or to defend legal claims: billing and financial records (typically up to 7 years under applicable accounting law), security and access logs (typically up to 12 months under applicable cybersecurity law), and records of consent for public use of your content (typically at least 5 years, as described in Section 6.4).
Our Privacy Policy describes data retention and your rights in more detail.
12. Disclaimers and Limitations of Liability
To the maximum extent permitted by applicable law:
- The Service, including all generated content, is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- ColabaseAI is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or business opportunities, arising out of or in connection with your use of the Service.
- Our aggregate liability arising out of or in connection with these Terms and your use of the Service is limited, to the maximum extent permitted by applicable law, to the amounts you paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
Mandatory consumer protections in your country of residence apply where such protections cannot be waived by contract, and nothing in this section limits liability for fraud, gross negligence, willful misconduct, or other liability that cannot be limited or excluded under applicable law.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless ColabaseAI and its officers, employees, and affiliates from and against any claims, damages, liabilities, and reasonable costs (including reasonable legal fees) arising out of: (a) Your Content; (b) your use of the Service in violation of these Terms or of applicable law; (c) your violation of any third-party rights, including intellectual property rights and privacy rights.
14. Changes to These Terms
We will reflect changes by updating the Effective date at the top of this page and recording a corresponding entry in the Changelog below.
For material changes (as defined in Section 1), we will provide reasonable advance notice and may notify you by email, in-product notice, or other reasonable means before the change takes effect.
Continued use of the Service after the new Effective date constitutes your acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the People's Republic of China. Any dispute arising out of or relating to these Terms or to the Service will be submitted to the competent courts of Shanghai, China.
Nothing in this section excludes mandatory consumer protection laws of your country of residence where such protections cannot be waived by contract.
